| dc.description | El Tratado de Lisboa ha supuesto un importante avance en la consagración y consolidación definitiva del Espacio Justicia en el seno de la Unión. El artículo 82.2 del TFUE concreta el marco de armonización procesal disponiendo que, con el fin de facilitar el reconocimiento mutuo de resoluciones en asuntos penales con dimensión transfronteriza, se podrán establecer un conjunto de normas mínimas que uniformen, entre otras, materias referentes a derechos de sospechosos y acusados, así como derechos de las víctimas. Al amparo de lo que se dispone en este artículo, han ido publicándose en los últimos años un conjunto de Directivas con las que se pretende conseguir el deseado equilibrio entre los valores de seguridad y justicia garantizando un abanico de derechos inviolables a todas las partes que se vean implicadas en un proceso penal en el seno de la Unión. La Directiva 2012/29/UE del Parlamento Europeo y del Consejo, de 25 de octubre de 2012, se enmarca en este contexto y responde a la necesidad de reforzar los derechos, el apoyo y la protección a las víctimas de delitos. Las disposiciones de esta directiva tratan de proteger a las víctimas durante el desarrollo del proceso, aportar soluciones tendentes a evitar la llamada “victimización secundaria” y reconocer un elenco de derechos y garantías que deben proporcionarse a la víctima con objeto que reciba información, apoyo y protección adecuada teniendo en cuenta sus necesidades específicas y la gravedad del daño sufrido. | es-ES |
| dc.description | The Lisbon Treaty was a major breakthrough in the strengthening and final consolidation of the Area of Justice within the European Union. Article 82.2 of the TFEU completes the framework of procedural harmonization by providing that, in order to facilitate the mutual recognition of judgments in criminal matters containing a crossborder dimension, a set of minimum uniform standards can be established throughout the Union relating to, among other matters, the rights of suspects and defendants, as well as victims’ rights. Based on this article, during recent years several directives have been enacted. These documents try to achieve the desired balance between the interests in security and justice, in order to guarantee a number of inviolable rights to all parties involved in criminal proceedings within the European Union. The Directive 2012/29/UE of the European Parliament and the Council of October 25, 2012 is part of this trend and particularly responds to the need to strengthen the rights, support, and protection of the victims of crime across the European Union. The provisions of the Directive seek to protect crime victims during the development of the legal proceedings, providing solutions aimed at avoiding a “secondary victimization” and establishing a catalogue of rights and protections for victims, who shall be entitled to receive information, support, and adequate protection, taking into account their specific needs and the severity of the harm they have suffered. | en-US |
