dc.descriptionCon la figura del consentimiento hipotético la jurisprudencia alemana ha trasladado al nivel de la antijuridicidad la consideración de los cursos causales hipotéticos en la determinación de la relación de imputación y de causalidad. Independiente de su origen en el contexto del tratamiento médico decidido autónomamente, la fundamentación dogmática de esa figura va mucho más allá del consentimiento en las lesiones corporales. El artículo trata de aclarar esas complicaciones teóricas teniendo a la vista la figura del consentimiento y las decisiones judiciales y administrativas que permitirían una afectación del bien jurídico protegido fundándose en un acto de disposición hipotético. Como se demostrará, este modo de proceder esconde el peligro de que los requisitos formales previstos para la justificación sean burlados a través de una reducción a los requisitos materiales de la correspondiente decisión.es-ES
dc.descriptionWith the concept of hypothetical consent, the German jurisprudence has shifted these considerations from an illegality inquiry to an unlawfulness examination. Notwithstanding its origins in the context of unauthorized medical treatments, criminal dogmatic substantiation of hypothetical consent goes far beyond consent in bodily injury. This article attempts to clarify those wider implications by considering not only consent but also sovereign decisions, by which interference of a protected legal right may be licensed, provided the unlawfulness is not expressly or implicitly sustained in the hypothetical disposition act. As will be shown, such an approach entails the hidden risk that formal requirements established for the justification of the decision are circumvented by reducing focus only on the material requirements of the corresponding decision.en-US
