dc.descriptionTo know how to deal with the ethnic/cultural burden inside a mediation process is without any doubt a debt in the current family mediation design in Chile. There is not public offer that treat this cases in an appropriate way, neither exist any offer from the Justice Ministry in the last tender rules to the family mediation services hiring, any consideration about to demand to the family mediators who live in the region that has the major native population, specific knowledge related to that topic it is quite worrying If we consider that exist a government obligation in this matter according to was exposed in the Agreement 169 of International Job Organization about native tribal people into independent countries, ratified for Chile in September 15th, 2008. This work propose to install the topic in an academic debate, thinking about their necessity and working on ways of intervention from family mediators when they face cases in which one or both of them belong to a native people specially mapuche people.en-US
dc.descriptionEl cómo abordar el peso de lo étnico y/o cultural dentro de un proceso de mediación, es sin duda una deuda del actual diseño de la mediación familiar en Chile. No existe oferta pública que aborde estos casos de una forma pertinente, ni existe por parte del Ministerio de Justicia, en las recientes bases de licitación para la contratación de servicios de mediación familiar, consideración alguna en cuanto a exigir a los mediadores familiares que viven en las regiones con mayor población indígena, conocimientos específicos en torno al tema. Lo anterior es preocupante si consideramos que existe una obligación estatal en dicho sentido, conforme a lo dispuesto en el Convenio 169 de la Organización Internacional del Trabajo sobre pueblos indígenas y tribales en países independientes, ratificado por Chile el 15 de septiembre de 2008. El presente trabajo propone instalar la temática en el debate académico, reflexionando acerca de su necesidad y analizando formas de intervención por parte de los mediadores y mediadoras familiares frente a casos en que una o ambas partes pertenezca a un pueblo originario y en especial al pueblo mapuche. es-ES
