El Código Sanitario y el Decreto Nº 6 de 2010 del Ministerio de Salud establecen la obligatoriedad de las vacunas obligatorias. En base a tales normas, los tribunales históricamente han reconocido el carácter obligatorio de esas vacunas, y han ordenado su aplicación incluso con el auxilio de la fuerza pública. Así se ha privilegiado la Salud Pública. Recientemente, en base al documento “Rechazo Informado”, que contiene el Ordinario B 27 Nº 4031 de las Subsecretarías de Salud Pública y de Redes Asistenciales, que en algunas oportunidades ha entendido como manifestación del consentimiento informado del artículo 14 de la Ley de Derechos y Deberes de los Pacientes, los tribunales han ido reconociendo un derecho a rechazar las vacunas obligatorias. Así se ha privilegiado la autonomía personal. Por todo ello es necesario responder si siguen siendo obligatorias las vacunas obligatorias, lo que precisamente pretende hacer este trabajo.The Sanitary Code and Decree No. 6 of 2010 issued by the Ministry of Health establish the mandatory nature of mandatory vaccines. Recently, following the “Informed Rejection” document published within Ordinary B 27 No. 4031 issued by the Undersecretaries of Public Health and Assistance Networks, which in some occasions has been understood as a manifestation of the informed consent of Article 14 on the Law on Rights and Duties of patients, courts have begun recognizing the right to reject mandatory vaccines. This is how personal autonomy has been given priority. Given all these reasons, it is necessary to answer if mandatory vaccines are still mandatory, which is precisely what this paper aims to do.
