| dc.description | Las concepciones dogmáticas del derecho niegan la posibilidad de convivencia en un mismo territorio, de sistemas jurídicos diversos, asegurando que el derecho estatal sea el único válido y a su vez, tenga carácter omnipresente. Este trabajo, analiza y discute la vigencia que tiene para las mujeres maya-mam del municipio de Colotenango, Guatemala, la resolución de sus conflictos en las instancias jurídicas disponibles a nivel local, en la articulación de un sistema jurídico positivo e indígena. En particular, interesa dar cuenta de la forma en que las mujeres han ido abriendo camino, a través de las barreras ligadas al racismo y sexismo del sistema jurídico positivo, así como a las expresiones patriarcales presentes en los espacios jurídicos comunitarios para poder enfrentar, denunciar y resolver situaciones cotidianas asociadas a la violencia de género. | es-ES |
| dc.description | Some dogmatic conceptions about justice deny the possibility that diverse legal systems can coexist in the same territory, ensuring that the State Law is the only valid one and also that it is present everywhere. This paper analyzes and discusses the effect on Mayan Mam women from Colotenango, Guatemala, facing the resolution of their conflicts in the legal instances available at the local level, in the context of articulation of positive legal and indigenous systems. In particular, we are interested in presenting an account of the way women have been leading with the barriers associated with racism and sexism of the positive legal system and the patriarchal expressions presents in indigenous communitarian instances, in order to confront, denounce and resolve everyday situations related to gender violence. | en-US |
