| dc.description | El problema de la «causa» ha sido una constante del pensamiento filosófico y jurídico. Desde ARISTÓTELES, han sido varios los pensadores que han pretendido esbozar algunas nociones en torno al tema, así por ejemplo, es posible mencionar a KANT, HUME, HEGEL, entre otros. Se debe indicar que en el campo de la filosofía, el tema no es pacífico, dando lugar a variadas disputas intelectuales. Para la desdicha de los juristas, esa complejidad se ha trasladado al ámbito jurídico. La presente investigación trata acerca de las diferentes concepciones de la causa en diversos ordenamientos jurídicos: el alemán, francés e italiano y la doctrina de la causa en el common law. Se enunciarán los aspectos generales más relevantes en torno a la doctrina de la causa en dichos sistemas. | es-ES |
| dc.description | The problem of the "cause" has been a constant of philosophical and legal thought. Since Aristotle, many thinkers have tried to outline some ideas on the subject, for example, Kant, Hume, Hegel, among others. It should be noted that in the field of philosophy, this issue is not peaceful, giving rise to various intellectual disputes. To the horror of lawyers, this complexity has been transferred to the legal field. This research deals with the different conceptions of the cause in various legal systems: German, French and Italian systems and the doctrine of cause in the Common Law. The most relevant and general aspects concerning the doctrine of the cause in these systems will be analyzed. | en-US |
