dc.description | This work explains the development of the direct applicability of fundamental rights in labor matters in some Latin American countries, where courts and legal doctrine postulate the validity of these rights as limits to the power of the employer. This applicability, commonly known as “horizontal effect” of fundamental rights between private individuals, is especially important in the field of labor law, as opposed to other areas of private law. Firstly, because contrary to what has been postulated by the constitutional narrative, this applicability originated within labor law at the beginning of the twentieth century, and secondly, because, with regard to labor law, this applicability does not increases judicial discretion, but, on the contrary, endeavors to limit corporate discretion. Consequently, by recognizing the particularisms of labor law, we will postulate that we are dealing with a diagonal, rather than a horizontal, effect of fundamental rights. | en-US |
dc.description | Este trabajo explica el desarrollo de la aplicabilidad directa de los derechos fundamentales en materia laboral, en algunos países de América Latina, donde los tribunales y la doctrina postulan la validez de estos derechos como límites al poder del empleador. Esta aplicabilidad conocida comúnmente como “eficacia horizontal” de los derechos fundamentales entre particulares, resulta especialmente importante en materia de derecho del trabajo, en contraste con otras áreas del derecho privado. Primero, porque a diferencia de lo postulado por la narrativa constitucional, esta aplicabilidad se originó dentro del derecho del trabajo a inicios del siglo XX y, segundo, porque esta aplicabilidad en materia laboral no aumenta la discrecionalidad judicial, sino que, por el contrario, logra limitar la discrecionalidad empresarial. Es por ello que al reconocer los particularismos del derecho del trabajo postularemos que se trata más bien de una eficacia diagonal y no horizontal de derechos fundamentales. | es-ES |
