| dc.description | This work analyzes the possibility of considering the exception known in the American legal system as the good faith exception, as an exception to the exclusionary rule established in article 276 section 3 of the Chilean Criminal Procedural Code. For this purpose, the work first tackles the issue through the American case law, where this exception was created, and then critically analyzing the approach taken by Chilean case law and legal scholarship regarding this subject. | en-US |
| dc.description | El trabajo analiza la posibilidad de considerar la “buena fe del agente” (en el derecho norteamericano conocida como good faith exception) como excepción a la aplicación de la regla de exclusión consagrada en el artículo 276 inc. 3° del Código Procesal Penal chileno. Para ello, el trabajo analiza el tema en primer lugar a partir de la jurisprudencia estadounidense, donde la referida excepción tiene su origen, presentándose a continuación una exposición crítica de la posición sostenida al respecto por la jurisprudencia y doctrina chilena. | es-ES |
