| dc.description | This article endeavours to carry out a brief comparison between negotiation in the Chilean and English legal systems, as a means of preventive control of unfair contractual terms, carried out by the main consumer rights protection agencies from both countries. In order to accomplish the aforementioned goal, the subject has been analysed according to the method of comparative law. Meaning, by means of specific comparative considerations concerning the regulation and application of preventive control via negotiation of unfair terms in each of the selected systems, it is determined which one of them has solved the problem better. From that analysis, it is concluded that the English model of control via negotiation has worked well and the Chilean legal system can learn lessons from it. | en-US |
| dc.description | Este artículo se propone realizar una micro comparación entre la negociación, como control preventivo de cláusulas abusivas, realizada por las principales agencias de protección de los derechos del consumidor en el ordenamiento jurídico chileno e inglés. Para lograrlo, se ha recurrido al método del derecho comparado. Es decir, mediante reflexiones comparativas específicas relativas a la regulación y aplicación del control preventivo por negociación de cláusulas abusivas en cada uno de los sistemas seleccionados, se determina cuál de ellos ha resuelto mejor el problema. De dicho análisis, se concluye que el control por negociación en el derecho inglés constituye un modelo de control preventivo de cláusulas abusivas que ha funcionado bien y del cual el ordenamiento jurídico chileno puede aprender. | es-ES |
