| dc.description | This paper deals with the regulation of the security measures applicable to criminally responsible by reason of insanity in the Chilean legal system, making a historical journey from the enactment of the Chilean Penal Code in 1874, up to the current regulations established in the Criminal Procedure Code of 2000. In parallel the expected situation will be analyzed currently in comparative criminal law (Spain, Germany, Italy, Argentina and Peru), of security measures in general and then the particular situation of not criminally responsible by insanity. Our goal is to report if necessary, establish a new legislation on security measures for mentally disturbed or introducing changes to the existing, based on comparative law analyzed, with the parameters: budgets, foundations and principles regulate the same. | en-US |
| dc.description | El presente trabajo se ocupa de la regulación de las medidas de seguridad aplicables a los inimputables por enajenación mental en el ordenamiento jurídico chileno, realizando un recorrido histórico desde la dictación del Código Penal chileno en el año 1874, hasta llegar a la regulación vigente establecida en el Código Procesal Penal del año 2000. Paralelamente se analizará la situación prevista, actualmente, en legislaciones penales comparadas (España, Alemania, Italia, Argentina y Perú), de las medidas de seguridad en general y luego de la situación particular de los inimputables por enajenación mental. Nuestro objetivo es dar cuenta de si es necesario, establecer una nueva legislación en materia de medidas de seguridad para enajenados mentales o incorporar modificaciones a la ya existente, en base a la legislación comparada analizada, teniendo como parámetros: los presupuestos, fundamentos y principios que regulan las mismas. | es-ES |
