| dc.description | The purpose of this paper is twofold: on the one hand, to highlight the inadequacy of the legal-penal good to fulfill a function of material legitimacy of Criminal Law and, on the other hand, to explain which principles must fulfill such function within a social and democratic State of Law. In order to do this, the paper is divided into two parts: the first deals with the theoretical evolution of the legal-penal good to the current prevailing conceptions, addressing the “crisis” that this institution has been experiencing for some time; in the second, we expose the contents on which, from our own conception, we consider that the material legitimacy of Criminal Law must be founded. | en-US |
| dc.description | El objetivo de este trabajo es doble: por un lado, poner de manifiesto la inadecuación del bien jurídico-penal para cumplir una función de legitimación material del Derecho Penal y, por otro, exponer qué principios deben cumplir con tal función dentro de un Estado social y democrático de Derecho. Para ello, el trabajo se divide en dos partes: en la primera se aborda la evolución teórica del bien jurídico-penal hasta llegar a las concepciones predominantes en la actualidad, abordando la “crisis” que esta institución lleva experimentando desde hace tiempo; en la segunda se exponen los contenidos sobre los que, desde nuestra propia concepción, consideramos que se debe fundamentar la legitimidad material del Derecho Penal. | es-ES |
