| dc.description | In this article the author, after observing the premise of his hypothesis the phenomenon of conflicts of interest that arise or may arise within the partnership agreement, proved by induction as true his thesis to explain this phenomenon using as game theory theorem; proposing so-since this contract is imperfect and incomplete, and often carries with it both a problem of asymmetric information as a need to develop strategies, our legal system provides context to develop various conflicts of power between the partners, as relatively opportunistic players are, most likely tend to maximize their benefits or rewards, but were willing to hold preliminary cooperative and non-zero sum more or less permanent in time. | en-US |
| dc.description | En este trabajo el autor, después de observar como premisa de su hipótesis el fenómeno de la existencia de conflictos de interés que se presentan o pueden suscitarse en el seno del contrato de sociedad, demuestra por inducción como verdadera su tesis de poder explicar este fenómeno usando como teorema la “teoría de juegos”; proponiendo así que –dado que este contrato es imperfecto e incompleto y suele llevar aparejados tanto un problema de información asimétrica como una necesidad de desarrollo de estrategias– nuestro sistema legal sirve de contexto para que se desarrollen diversos conflictos de poder entre los socios que –como jugadores relativamente oportunistas que son– muy probablemente tenderán a maximizar sus beneficios o recompensas, si bien preliminarmente estaban dispuestos a sostener relaciones cooperativas y de suma no nula más o menos permanentes en el tiempo. | es-ES |
