| dc.description | The research presented is referred to the actions carried out by the judge in the stages previous to the chilean simplified trial and how that previous guaranty labor he performs may affect his objective impartiality when subsequently he must know and judge the same case in the abovementioned simplified oral trial. To determine which performance was susceptible to be considered as an action that may affect the objective impartiality, it was created a test of protective omissions to avoid polluting activities of the impartiality; this test was created by three factors. Also, it was modeled a standard based in the international jurisprudence from case to case, that after the application of the test it works as a corrector for the hypothesis of the proposed action. | en-US |
| dc.description | La investigación que se presenta está referida a las actuaciones que realiza el juez de garantía en las etapas anteriores al juicio simplificado chileno y cómo esa labor garantizadora previa que desempeña puede afectar su imparcialidad objetiva cuando con posterioridad debe conocer y juzgar el mismo caso, en el mencionado juicio oral simplificado. Para determinar qué actuación era susceptible de ser considerada afectadora de la imparcialidad objetiva, se construyó un test de omisiones protectoras de actividades contaminantes de la imparcialidad que fue constituido por tres factores. Asimismo, se modeló un estándar seguido por la jurisprudencia internacional del caso a caso, que luego de la aplicación del test, funciona como corrector para las hipótesis de actuación propuestas. | es-ES |
