A study is conducted on the unfitness to stand criminal trial due to alteration or insufficiency of the defendant’s mental faculties. First, we cover some theoretical aspects of the fitness to stand trial of this subject of the criminal process, to then exam the legal rules that determine the course of action before a probable unfitness to stand trial, whether initial o supervening, and the activities further to its occurrenceSe realiza un estudio sobre la incapacidad procesal del imputado debida a la alteración o insuficiencia de sus facultades mentales. Primero se abordan aspectos teóricos sobre la capacidad de este interviniente en el proceso penal, para luego hacer un examen de las disposiciones legales que regulan el curso a seguir ante la probable incapacidad inicial o sobrevenida del sujeto, y la actividad posterior a su verificación.
