| dc.description | This paper analyses the art. 14 bis Berne Convention related to authorship and first ownership of copyright of cinematographic work in the context of domestic legislative plurality. On the one hand, the work points out the need for a conflictual rule, in the absence of a international common substantive rule determining the authorship of a cinematographic work. On the other, the work analyzes the solutiones offered by the aforementioned art. 14 bis of the Berne Convention, in particular, the ownership of copyright in cinematographic work as a matter for legislation in the country where protection is claimed or lexi loci protectionis, and the substantive restrictions to its scope, noting its rare virtues, and, above all, those deficiencies that make it a scarcely useful rule in practice | en-US |
| dc.description | Este trabajo tiene por objeto el análisis del art.14 bis Convenio de Berna regulador de la autoría y/o titularidad original de los derechos de propiedad intelectual sobre las obras cinematográficas en el ámbito internacional Por una parte, y en un contexto de pluralidad legislativa nacional, se encarga de señalar la necesidad de una respuesta conflictual, en ausencia de una normal material común determinante de la autoría de una obra cinematográfica. Por otra, se encarga de analizar el referido art. 14 bis Convenio de Berna y sus soluciones, en concreto, la remisión que hace a la lex loci protectionis y las restricciones que el legislador de la Unión de Berna incorpora a su alcance, señalando sus escasas bondades, y, sobre todo, aquellas carencias que lo convierten en un precepto escasamente útil en la práctica. | es-ES |
