Abstract
Art. 183-E of the Labor Code refers to the direct liability of the parent company in case of noncompliance with the duty of care imposed by that provision. To determine the parent company's liability for a work-related accident requieres a clear determination of whether its conduct or omission constituted a noncompliance with its personal and direct obligation of care, as well as to establish the relationship between that conduct and the damages that are claimed. The owner's liability when dealing with a work-related accident may only be declared pursuant to a noncompliance of his own and particular obligations, as imposed by the law and not as a guarantor of the employer's obligations El art. 183-E del Cdt se refiere a la responsabilidad directa que recae sobre la empresa principal para el evento de que incumpla el deber de cuidado que el mismo texto le impone. Perseguir su responsabilidad por un accidente del trabajo supone determinar claramente la conducta que por acción u omisión de su parte configuró un incumplimiento de ese deber personal y directo, así como la relación entre esa conducta y los daños reclamados. La responsabilidad del dueño de la obra en un accidente del trabajo sólo puede ser declarada en virtud de un incumplimiento de las obligaciones propias y particulares que la ley le ha impuesto sobre la materia y no como garante de las obligaciones que ha debido cumplir el empleador.
