In almost every jurisdiction, and Chile does not constitute an exception, property is highly protected. It is defined in our Civil Code as an absolute real right that allows the owner to use, enjoy and dispose of a thing arbitrarily, while not against the law or the rights of rhird parties. Our Constitutions, in its turn, gives property special protection including it within the fundamental guarantees.       What motivated the fact that property receives an equivalent protection to that of internationally recognized fundamental rights? It is only for practical reasons or are we facing a real human right? The answer to these questions is what we believe, will justify or no its protection.En prácticamente todos los ordenamientos jurídicos, y el chileno no es la excepció, la propiedad goza de una enorme protección. Se encuentra definida en nuestro Código Civil como un derecho real absoluto que permite usar, gozar y disponer de una cosa arbitrariamente, en tanto no sea contra la ley o el derecho de un tercero; nuestra Constitución por su parte, le otorga una protección especial al incluirla dentro de las garantías fundamentales.         ¿ Qué ha motivado que la propiedad reciba una protección equivalente a la de derechos iternacionalmente reconocidos como fundamentales?¿ello se explica sólo por cuestiones prácticas o nos encontramos realmente frente a un derecho humano?  la respuesta a estas interrogantes nos dirá si dicha protección se encuentra o no justificada.
