LA TERCERÍA DE DOMINIO EN LOS DERECHOS DE AUTOR EN ESPAÑA

Abstract
The Intellectual property is a special right that includes economic and moral rights. This economic right gives to the creator the power to exploit their work. The author has the right to obtain financial gain of his creation. He also has the authority to transfer these rights to another person. The author doesn’t transfer his economic intellectual rights, he only transfer the economic output and it is the product and profit resulting from the use of these rights. This transfer is usually done through a contract of assignment. These economic intellectual rights are purely economic so their product, profit and income could be liable by a kind of Mareva injunction (used in Spain). If the author transfer these right to another person (third person), and a creditor of the author gets a Mareva injunction over this product, this third person has the right to sue domain of third party starting, according to the transfer contract. If the third person succeeds in proving in the trial that this product profit and income are his, he will win the trial and get back all that profit was take away by the Mareva injunction Los derechos de autor son unos derechos especiales que engloban derechos morales y patrimoniales. Los derechos patrimoniales del autor constituyen la facultad que tiene el creador para explotar su obra. El autor tiene el derecho de obtener ganancias económicas de su creación. Asimismo, tiene la potestad de transferir estos derechos a favor de otra persona. Se transfiere el producto económico que se obtiene con la explotación de la obra, es decir, los frutos y rentas resultantes de la utilización de estos derechos. Esta transferencia se realiza usualmente a través de la celebración de un contrato de cesión. Los derechos de explotación del autor son netamente patrimoniales, por lo tanto, sus frutos y rentas sean posibles de embargo. Si el autor cede estos derechos a otra persona (cesionario), y un acreedor de dicho autor embarga los frutos o productos de esa obra, el cesionario estará legitimado para interponer una demanda de tercería de dominio afirmando que esos frutos ya no le pertenecen al autor, sino a él, de acuerdo al contrato de cesión celebrado con dicho autor. Si el demandante tercerista consigue probar que los frutos y rentas embargados fueron cedidos a su favor en exclusividad y antes de que se produjera el embargo, el tribunal declarará fundada la demanda, ordenando se levante dicho embargo y se le restituyan los frutos embargados.
