dc.descriptionCurrently, in the opinion of many, human rights are but just a reality built on consensuses or democratic majorities reached occasionally, and not a piece of information discoverable little by little. This had caused a considerable change not only in what refers to its content and scope, but also concerning its titleholders. The reason is that through these consensuses or majorities, entire categories of human beings have beem excluded in the quality as persons (and therefore, of their fundamental rights, starting wirh their right to life), based on the fact that they do not meet the requirements for those majorities or consensuses to enjoy such quality. This causes the end of the essential equiality between all men, but also the destruction of  the very notion of "human rights". The present article analyzes several of the reasons presented by those favoring the exclusion of the status personae of diverse groups of human beings, and the most relevant consequences of such exclusion. Finally, it attempts to show the inadequacy of such reasoning process from several viewpoints, because they stem from an authentic vicious circle.en-US
dc.descriptionActualmente, para vastos sectores, los derechos humanos son sólo una realidad construida a partir de consensos o mayorías democráticos alcanzados de cuando en cuando, y no un dato que hasta cierto punto, debe ir descubriéndose poco a poco. Lo anterior ha ocasionado un cambio considerable no sólo en lo que se refiere a su contenido y alcance, sino también respecto de sus titulares. Ello, porque mediante estos mismos consensos o mayorías, categorías enteras de seres humanos han sido excluidos de su calidad de persona (y por tanto, de sus derechos fundamentales, partiendo por el derecho a la vida), en atención a no reunir los requisitos exigidos por esas mismas mayorías o consensos para gozar de tal calidad. Esto trae como consecuencia no sólo el fin de la igualdad esencial entre todos los hombres, sino además, la destrucción de la propia noción de “derechos humanos”. El presente artículo analiza algunos de los motivos esgrimidos por quienes están a favor de la exclusión del status personae de diversos grupos de seres humanos, y las consecuencias más relevantes de dicha exclusión. Finalmente intenta mostrar la improcedencia de tal modo de razonar desde varias perspectivas, en atención a darse en todas ellas un auténtico circulo vicioso.es-ES
