Thanks to the chilean normative identity the doctrine and the jurisprudence about swindle have worried mainly on the deceit, in decline of the damage. In the present work will be tried to maje the foundations of a normative construction of the concept of  damage in the swindle that could be able to respond to the needs of today's criminal policyGracias a la identidad normativa chilena la doctrina y jurisprudencia sobre la estafa se han preocupado mayormente sobre el engaño, en desmedro del perjuicio. En el presente trabajo se intentarán elaborar los cimientos de una construcción normativa del concepto de perjuicio en la estafa que sea capaz de responder a las necesidades político-criminales hoy.
