The constitutional conflict which must be solved through a juridical process, in our opinion has not defined critera nor guidelines or clear rules with respect to the application of a General Theory of the Evidence. Besides the national constitutional dogmatic, this statement can be formulated either by the repeated omission on the extent and validity of the Evidence in the constitutional process or by the legislator itself. In fact, in this case, systematic regulations of the Evidence are not done either on the present Constitutional Law of the Chilean Constitutional Court nor in it legal modification, which will be soon promulgated by the President of the Republic. Only from some dispositions it can be inferred that it will be possible to provide antecedents in the constitutional process but without specifying in wich or under what structure it will be performed. These failures would allow us to outline some troubles for the judges when solving a conflict inside his functions. Based on the previous description, we recognize that, as long as the non acceptance that the constitutional conflict must be solved thorugh a process, the Judicial Evidence in te Constitutional Justice will remain as a nebulous topic. Fortunately, at least in Chile, it has recently acquired some relevance in the sentences pronounced by the Constitutional Court. These have been done in subjects with scientific and juridical high complexity but of ethic extent such as the so called case of the "Pill of the day after", what compel us to conclude that clearness and systematic nature are required in the use and applications of the Juidical Evidence fromt the medium named to know the subject.El confilcto constitucional, debiendo dirimirse a través de un proceso jurisdiccional, no cuenta, según nuestra opinión, con criterios definidos o pautas o reglas claras respecto de la aplicación de una teoría general de la prueba. Esta crítica se puede formular, por un lado, a un sector de la dogmática-constitucional nacional, por la omisión reiterada al alcance y vigencia de la prueba en el proceso constitucional y, por otra parte, al propio legislador. En efecto, en este caso, no se advierten regulaciones sistemáticas de la prueba ni en la actual Ley Orgánica del Tribunal Constitucional Chileno ni en la modificación legal de ella, próximamente a ser promulgada por la Presidenta de la República; sólo de algunas disposiciones se puede inferir que en el proceso constitucional se podrán aportar antecedentes, pero sin detallar cuales y bajo qué estructura, lo que nos permitiría esbozar ciertas dificultades de los jueces al momento de resolver un conflicto que esté dentro de sus atribuciones. De lo anterior, reconocemos que la prueba judicial en la justicia constitucional es un tema nebuloso, mientras se asienta la conciencia que el conflicto constitucional se resuelve en un proceso; pero en el último tiempo -  al menos en el caso de Chile - ha adquirido relevancia por fallos que ha pronunciado el Tribunal Constitucional en materias con alta complejidad jurídica y científica, pero de claro alcance valórico, como fue el llamado caso "Pildora del día después", lo que nos fuerza a concluir que se requiere claridad y sistematicidad en el uso y aplicación de la prueba judicial, por parte del órgano llamado a conocer del asunto.
