| dc.description | En el presente estudio, el autor examina el rol clásico asignado por el Derecho Penal a la reparación del daño causado por el delito y las modernas tendencias politíco-criminales en esta materia, que persiguen restituir a la víctima su protagonismo en la solución del conflicto. Expone las teorías que propugnan una "tercera vía" en la respuesta del Derecho Penal frente al delito, consistente en la reparación del daño, enarcada en el elenco sancionatiorio, en calidad de pena autónoma. Vincula las propuestas del Derecho Penal sustantivo a las nuevas regulaciones del Código Procesal Penal chileno, referidas a la reparación del daño provocado a la víctima y destaca la reparacipon como pena autónoma en la Let N°20.084. | es-ES |
| dc.description | In this article, the author reviews the reparation in criminal law from the perspectives of the traditional penal codes and the modern trends in this subject. He exposes the diferent theories about a "third way" in Criminal Law, represented by the reparation of the damages caused by the crime, which have been traditionaly considered as a extenuating circumstance and should now integrate the catalog of penal sanctions as an autonomous punishment. The proposals of the substantive penal law are relate to the new regulations of the Criminal Procedure Code and also the new Law of Juvenile Criminal Responsibility recently enacted after an intensive and extended discussion at the chilean Congress. | en-US |
