| dc.description | Sin que el objeto de este trabajo sea determinar la significación del concepto de falta de servicio público como fundamento de la responsabilidad sanitaria pública, en estas breves líneas nos referiremos a cómo derecho comparado e incipientemente el derecho nacional ha dirigido su atención hacia la deficiencia organizacional como factor de atribución de los órganos sanitarios, entendiendo que la responsabilidad de dichos órganos no se agota en la falta personal del funcionario generador de la actuación dañosa, o, en el mero incumplimiento de las normas que rigen la actividad sanitaria, sino que resulta además estrictamente necesario atender a la forma cómo la respectivas entidades se estructuran y organizan para cumplir su obligación de prestar salud y atención médica a los administrados, resultando éstas en consecuencia, responsable de los daños que las deficiencias estructurales causen a los pacientes que requieren la asistencia sanitaria. | es-ES |
| dc.description | The determination of the concept of lack of public service, as a ground for public health liability, is not the object of this study. This study refers birefly to comparative law and the growing body of national law, which have directed their attention to organizational deficiency as a ground for public services liability. The liability of public services is not exhausted in the fault of individual agents whose conduct generates the damage or in the mere lack of compliance with norms regulating sanitary activities. Moreover, it is indispensable to review the manner in which public health institutions are structured and organized for compliance with their obligation to provide health services for their users. In consequence, public health institutions are liable for the structural deficiencies caused to patients requesting sanitary assistance. | en-US |
