La compensación económica introducida por la Ley 19.947, Nueva Ley de Matrimonio Civil, se incorporó como una institución nueva para el ordenamiento jurídico nacional. Esta cirscunstancia, unida al hecho de que en su redacción definitiva no se han seguido las fórmulas exactas adoptadas por los sistemas que le sirvieron de modelo, conlleva la díficil labor de comenzar a delinear sus caracteres a partir de la breve reglamentación que la rige. Es en este escenario que, luego del análisis de la ley, sostenemos que la compensación económica participa de un carácter dispositivo, en virtud del cual se reconoce aplia libertad a los cónyuges para realizar actos jurídicos sobre ella. El principio de "protección al cónyuge más debil" no se opone a esta característica.The economic compensation introduced by the New Chilean Matrimonial Act of 2004 was introduced as a new legal institution for the national juridical system. This circumstance, next to the fact that its drafting did not follow the exact lines adopted by the systems from which it was taken, bears the difficulty of outlining its character because it is guided only by the brief regulation that governs it. It is in this scenario, after analysing the rules of the Matrimonial Act, that we support the economic compensation which has a disposable character, and which allows the spouses to carry out any judicial acts on their own compensation. The "proctection principle to the weakest spouse" does not oppose this characteristic.
