El trabajo pretende poner de manifiesto la necesidad de perfeccionar la acutal institucionaliad laboral de tal forma que ésta pueda asegurar un ejercicio pleno y efectivo de la negociación colectiva, en el entendido que un Estado de Derecho, para poder ser tal, debe velar por que todos los ciudadanos tengan la posibilidad cierta de materializar en su vida cotidiana las libertades y garantías implícitas en el contenido esencial de los derechos fundamentales. Con todo, debido a la amplitud de factores que involucra un examen de esta naturaleza, se ha optado por circunscribirlo a la problemática que supone el limitado objeto que posee la negociación colectiva en el Código del Trabajo, lo cual presenta de por sí un marco representativo para contrastar la pugna de visiones sobre los alcances jurídicos de la libertad sindical y la incidencia del modelo económico neoliberal en la conformación de la legislación laboral y vigente.The work tries to reveal the need to improve the current labour institution in such a way that this one could assure a full and effective exercise of the collective bargaining; understanding that a Constitutional state, to be able to be such, must watch that all the citizens have the possibility of materializing in their daily lives the freedoms and implicit guarantees in the essential content of the fundamental rights. With everything, due to the extent of factors that involves an examinitation of this nature, it has chosen to circumscribe it to the problematic that supposes the limited object that possesses the collective bargaining in the Labour Code, which presents for Itself a representative frame to contrast the struggle of visions on the juridical scopes of the union freedom and the incident of the economic neoliberal model in the conformation of the current labour legislation.
