El presente artículo busca descubrir los antecedentes históricos que dieron origen a los Principios del Derecho Internacional actual; conectando la Historia y el Derecho. Se hace referencia a las características generales que alcanzó la conquista de América, el desplome demográfico de los pueblos aborígenes y la protección por parte de la corona de Castilla.   Además se precisan los justos títulos que exhibieron los Reyes de España para la conquista de las Indias y toda la discusión jurídica que se dio dentro del Imperio Español para presnetar, estos antecedentes, a los pueblos ocupados y a las potencias europeas.  De esta discusión jurídica - filosófica se crearon los Principios modernos del Derecho Internacional Público.The present articles tries to discover the historical precedents that gave origin to the Beginning of the current International Law; connecting the History and the Law. There is done a reference to the general characteristics that there reached the conquest of America, the demographic collapse of the aboriginal villages and the protection by the Castilla's crown.  In addition are specified the just titles that the Kings of Spain exhibited for the conquest of the Indies and the whole juridical discussion that was given inside the Spanish Empire to present, these precedents, the occupied villages and the European powers.   Of this Juridical discussion -  philosophical the modern Beginning of the Public international law was created.
