| dc.description | Sobre la base de dos distinciones conceptuales: "Error de tipo" frente a "error de prohibición", en este artículo se argumenta (y se comabte) la doctrina "tradicional" que postula que el dolo tiene dos elementos y está contemplado en la voz "voluntaria" que utiliza el artículo 1° del Código Penal; que el error de tipo eliminal el dolo y el error de prohibición la culpabilidad. En el actual Derecho Penal, no cabe seguir sosteninedo que la voz voluntaria significa dolo y que el error de prohibición se ubica en la culpabilidad. El dolo tiene ubicación sistemática en el tipo de injusto; y tanto el error de tipo como el de prohibición son negaciones de él, puesto que sólo está constituido por el elemento cognoscitivo (de los elementos del tipo y de las valoraciones o normas que el tipo publica). | es-ES |
| dc.description | On the base of two conceptual distinctions; "Mistake of type" opposite to "Mistake of prohibiton" in this article it is argued (and there fights) the "traditional" doctrine that postulates that the deceit has two elements and is contemplate in the "voluntary" voice that uses the article 1° of the Penal Code; that the mistake of the type eliminates the deceit and the mistake of prohibiton the guilt. In the current Criminal law, it is not necessary to continue holding that the voluntary voice means deceit and that the mistake of prohibition is located in the guilt. The deceit has systematic location in the type of unjustly; and so much the mistake of the type as that of prohibiton they are denials of him, since only it is constituid for the cognitive element (of the elements of the type and of the valuations or procedure that the type publishes). | en-US |
