| dc.description | Modernización o expansión del Derecho penal, son dos conceptos "cardinales" en el debtae doctrinario actual. Sobre la base de las posturas de dos destacados exponentes de la dogmática española actual, se realiza aquí una visión crítica del estado de la cuestión. Se rechaza la falacia disyuntiva que algunos propugnan entre garantías y modernización o expansión, abógandose por el abandonado de posiciones extremistas. Así, aquí se argumenta a favor de la modernización, pero, sin olvidar que para que sea equiparable a "evolución" o "desarrollo" debe llevarse a cabo, por definición, dentro de los márgenes del Estado Social y Democrático de Derecho. | es-ES |
| dc.description | Modernization or expansion of criminal law are two "cardinal" concepts in the present doctrinaire debate. On the basis of two arguments chosen by two representatives in the current Spanish doctrine, a critical point of view concerning the status of this question is developed. I refrain from the extreme position, which has been proposed by some critics, to push modernization forward without respecting rights and guarantees. Therefore, I argue in favour of modernization. But to gain a modernization which is comparable to an evolution or development it, by definition, must be carried out within the margins of the social and Democratic State of Rights. | en-US |
