| dc.description | El trabajo expone los principales desafíos que se plantean al ordenamiento jurídico frente al fenómeno psicológico y sociológico que se ha dado en llamar transexualismo, es decir, de personas que estiman que sus caracteres sexuales genéticos y fisiológicos no se corresponden con la atribución psicológica del sexo al que entienden pertenecer. Se analizan las distintas soluciones que se han ensayado en el derecho contemporáneo, en especial la autorización para rectificar la identidad civil conforme al sexo deseado, previa intervención quirúrgica que intenta emular artificialmente los genitales y los caracteres físicos del nuevo sexo, incluyendo en algunos casos la autorización para contraer matrimonio con personas del mismo sexo original del transexual con sexo rectificado. El autor se muestra escéptico respecto de las bondades de estas medidas y se cuestiona sobre si ellas no constituyen más bien un abandono de estas personas de los problemas que desgraciadamente las aquejan. | es-ES |
| dc.description | This work deals with the main challenges that legal regulations have in face of both psychological and sociological phenomena that has been called transsexualism, that is, of people who believe that their sexual genetic and physicological features do no match their physiological attribute of gender to which they think they belong to. It analyzes several solutions that have been tested in contemporary law, particulary the authorization tho change the legal identification according to the chosen gender, prior to a surgical sex intervention that intends to emulate artificially both genitals and physical characteristics of the new gender, including, in some cases, the license to get married to people of the same original gener of transexual with rectified gender. The author is skeptical of the adventages of these measures and wonders if they rather are a neglect of the problems that unfortunately this people suffer. | en-US |
