Se analiza aquí la facultad de un codeudor de una obligación indivisible que ha sido demandado para pedir un plazo para entenderese con sus codeudores a fin de cumplirla entre todos, y la excepción en que se niega la facultad dando la obligación es de tal naturaleza que el demandado pude cumplirla solo. Se estudia la norma del artículo 1.530 del Código Civil chileno desde una perspectiva gramatical-lógica e histórica distinguiéndose sus elementos. Se analizan los orígenes históricos de la institución y la posibilidad de admitir una innovación de Bello en esta materia.In this article it is analyzed the right of a debtor of an indivisible obligation that has been sued, to ask for a deadline so that he can reach an agreement with the rest of the debtors in order to fulfil the obligation, and the exception in which this right is denied, when the nature of the obligation allows this debtor to fulfil it on his own. It is studied the rule contained in the article 1530 of the Chilean Civil Code from a grammatical-logical and historical perspective, distinguishing it's elements. The historic origins of the rule and the possibility of admitting an innovation done by Andrés Bello in this matter.
