Tradicionalmente, y de acuerdo con su cuñación por el finalismo, el dolo ha venido siendo entendido casi forma pacífica como la conciencia y voluntad de la realización de los elementos objetivos del tipo. En efecto, de esta deficinición se deduca la necesaria concurrencia de dos elementos en el dolo: el elemento intelectual y el elemento volitivo. Por consiguiente, el primero, el elemento intelectual, comporta la conciencia por parte del sujeto de la realización  de todos y cada uno de los elementos del tipo objetivo; mientras que el segundo elemento, el volitivo, exige que la voluntad del sujeto abarque la realización de dichos elementos o la previsión de su realización.Traditionally, and according to its coining by the finalismo dolus (fraud) has been understood, in a pacific form, as the conscience and will of the execution of the objective elements of the type.
