Este trabajo tiene por finalidad otorgar ciertos tópicos que sirvan de sustento para el reconocimiento a las personas jurídicas de la titularidad del derecho a vivir en un medio ambiente libre de contaminación contenido en el art. 19 N° 8 de la Constitución Política. Además da cuenta de cómo ha operado la titularidad en cierta jurisprudencia de nuestros tribunales y los criterios para otorgársela a una Corporación de Derecho Privado dedicada al Medio Ambiente en recurso de protección1. El principal argumento bajo el cual se afirma esta titularidad es el interés público o colectivo por el cual se justifican ciertas personas jurídicas, además del objeto o fin para el cual fueron creadas. La revisión de ciertos fallos de la Corte Suprema son esenciales para justificar y probar nuestra tesis.This paper have the propose to give some topics for the recognizing the fundamental right to live an unpolluted environment to legal persons incorporated in article 9 of the Constitution of Chile. And also give us some approach in how the Courts has been decided about the entitlement and the criteria of our tribunals to recognizing that entitlement to a private law corporation dedicated to environmental matters, in protection action. The main argument of the entitlement is the public interest by which certain legal persons are justified, the object and the proposes of their creation. The review of some decisions of the Supreme Court is essential to proof and argue the thesis.
