| dc.description | En relación con la aplicación del Recurso Jerárquico en nuestro Derecho Público, la jurisprudencia de la Contraloría General de la República ha tendido a establecer que, por el hecho de existir desconcentración funcional respecto de un órgano público, y, por ende, no posea competencias el superior jerárquico del mismo sobre éste, ello imposibilita la interposición de tal recurso. Se postula en esta ponencia que tal posición, llevada al nivel de dogma, debe ser revisada y analizada caso a caso en pos de proteger los derechos esenciales del administrado. | es-ES |
| dc.description | In relation to the application of the Hierarchical Appeal in our Public Law, the jurisprudence of the Comptroller General of the Republic has tended to establish that, due to the existence of functional deconcentration with respect to a public body, and, therefore, its hierarchical superior does not have competences over it, it makes the interposition of such appeal impossible. It is postulated in this paper that such a position, taken to a dogmatic level, must be reviewed and analyzed case by case in order to protect the essential rights of the administered. | en-US |
