| dc.description | La institución de la delegación legislativa en el Presidente de la República es de larga data en nuestra historia constitucional, sin embargo su reconocimiento formal comienza sólo con la reforma constitucional de 1970 que modificó la Carta de 1925, y que luego la Constitución de 1980 mantuvo, en lo general, en términos similares. La particularidad de esta forma de legislación delegada no está exenta de problemas. En concreto, el trabajo centrará su análisis en dos cuestiones no del todo clarificadas, por una parte, lo concerniente a los alcances de la legislación delegada, y, por otra parte, su control por los órganos jurisdiccionales, especialmente el que lleva a cabo el Tribunal Constitucional. | es-ES |
| dc.description | The regulatory authority of the President is a long-standing institution in our constitutional history. However, its formal recognition starts only with the constitutional reform in 1970, which modified the 1925 Constitution. After that, the 1980 Constitution maintained, in general terms, this recognition. The peculiarity of this kind of regulatory authority, it is not without its problems. This work will focus on the analysis of two issues not clearly defined. On one hand, the scopes of the delegated legislation and on the other one, its control exercised by the jurisdictional authority, specially the one carried out by the Constitutional Court. | en-US |
