| dc.description | Este artículo examina el origen histórico y la evolución del derecho a vivir en un medio ambiente libre de contaminación, reconocido en la Constitución Política chilena, y las actuales tendencias del derecho comparado en cuánto a su regulación y reconocimiento. Se plantea el dilema de su naturaleza ambivalente de derecho individual y social, insertando su análisis en lo que puede denominarse el constitucionalismo medio ambiental, sus incidencias en el derecho público y administrativo, y la importancia de concebirlo con mayor amplitud como un deber constitucional de protección de la naturaleza que obliga a todos sin distinción. | es-ES |
| dc.description | This article examines the historical origins and evolution of the right to live in a pollution free environment, recognized in the Chilean Constitution, and current trends of comparative law in regulation and recognition. The dilemma of its ambivalent nature of individual and social rights arises, inserting his analysis on what may be called the environmental constitutionalism, their impact on the public and administrative law, and the importance of conceiving it more broadly as a constitutional duty to protect nature which requires all person without distinction. | en-US |
