dc.descriptionAccording to Francisco Suárez, human nature is the ultimate foundation of politics and of civil obedience. In virtue of his similarity to God, the human legislator participates in that dominion. This one, in turn, constitutes the legislator’s moral faculty to order and impose laws to his fellow kind, since his will is a fundamental condition so that citizens, united in a mystic body, can reach their natural end. In this way, the legislator receives his power from the men’s community so as to oblige them through laws. These ones do not only refer to common good, but they should also be given in proportion to human knowledge. So as to do this, laws should be promulgated efficiently through an act of speech that evokes obligation and which transmits the legislator’s will to the community in a sensible way. The sensible elaboration of the legal formula comes next, which allows the legislator’s intention to permeate the subjects’ minds to engender moral duty.en-US
dc.descriptionDe acuerdo con Francisco Suárez, la naturaleza humana es el fundamento último del dominio político y de la obediencia civil. En virtud de su semejanza con Dios, el legislador humano participa del dominio de aquel. Dicho dominio constituye una facultad moral del legislador humano para mandar e imponer leyes a sus congéneres, pues su voluntad es una condición necesaria para que los ciudadanos, unidos en un cuerpo místico, alcancen su fin natural. De esta manera, el legislador recibe el señorío de parte de la comunidad perfecta de hombres para obligarlos a través de leyes. Las cuales, no solo han de versar sobre el bien común, sino que además han de ser dadas de manera proporcional al conocimiento humano. Para lo cual, hace falta que sean suficientemente promulgadas a través de un acto de habla que produzca la obligación y transmita la voluntad del legislador a la comunidad bajo una forma sensible. Luego la acción legislativa es la elaboración sensible de la fórmula legal que vehiculiza la intención del legislador penetra en la mente de los súbditos para engendrar el deber moral.es-ES
