| dc.description | The present commentary exposes a critical vision of the sentence dictated by the Chilean Constitutional Court on the occasion of the requirements referred to the bill “aborto tres causales”. For this, after succinctly explaining the content of the requirements and the main argumentative line developed by the Court to deny the status of person to the nasciturus, the considerations exposed to motivate that decision are critically evaluated. Special emphasis is given to their disagreement with the new understanding of the personality that has developed in Civil law, based on the values involved in human rights. | en-US |
| dc.description | El presente comentario expone una visión crítica de la sentencia dictada por el Tribunal Constitucional chileno con ocasión de los requerimientos referidos al proyecto de ley “aborto en tres causales”. Para ello, luego de explicar sucintamente el contenido de los requerimientos y la principal línea argumentativa desarrollada por el Tribunal para negar al nasciturus el estatus de persona, se evalúan críticamente las consideraciones que fundamentaron esa decisión, con especial énfasis en su disconformidad con la nueva comprensión de la personalidad que se ha desarrollado en el derecho civil, a partir de los valores que están involucrados en los derechos fundamentales. | es-ES |
