However, even if the State recognizes the person's right to sexual adequacy, there is no prediction about the person's social security situation, which creates legal uncertainty regarding the right to retirement. Considering that the time of contribution for the granting of retirement is different for men and women, it remains to establish a rule of protection for people who change their sex, allowing both the right of retirement and the financial balance of Social Security. | en-US |

Contudo, mesmo que o Estado reconheça à pessoa o direito de adequação sexual, não há previsão acerca da situação previdenciária da pessoa, o que gera incerteza jurídica quanto ao direito de aposentadoria. Considerando que o tempo de contribuição para concessão de aposentadoria é diferente para homens e mulheres, resta estabelecer uma regra de proteção para as pessoas que mudem de sexo, permitindo tanto o direito de aposentadoria quanto o equilíbrio financeiro da Previdência Social. | pt-BR |
