dc.descriptionThe “disputed material facts” depend on the object of the process. In order to determine these facts, the judge must consider the narratives of litigants and the convergence between the primary facts and evidential facts from the case. Accordingly, the law must require lawyers not to use generic stories, and the facts contained in the court decision orde- ring present evidence must not be generic either. Based on an example of tort law, this paper shows that the hermeneutic approach rather than the analytical one provides justification for the convergence between both types of facts.en-US
dc.descriptionLos “hechos sustanciales controvertidos” dependen del objeto del proceso. Para determinar estos hechos el juez debe considerar los relatos de las partes y la convergencia en- tre los hechos principales y los probatorios. Por eso, la ley procesal tiene que exigir a los abogados que sus narraciones no sean genéricas, como tampoco han de ser genéricos los hechos de la resolución que recibe la causa a prueba. En base a un ejemplo de la responsabilidad civil se demuestra que el enfoque hermenéutico, más que el analítico, es el que le permite al juez justificar la convergencia entre ambas clases de hechos.es-ES
