dc.descriptionThis paper aims to examine the irrevocable mandate in civil, commercial and consumer matter and irrevocability arises, first, as a result of an agreement to that effect and secondly as a result of the presence of interests of the representative or thirds. We question the general acceptance of the irrevocable mandate without previously making these distinctions that are fundamental to rule on its acceptance or rejection. The issue has enormous practical interest because it has become customary to introduce this kind of mandates in all types of contracts, especially in adhesion ones.en-US
dc.descriptionEste artículo tiene por objeto central examinar los mandatos irrevocables en materia civil y comercial para, luego, analizar la irrevocabilidad que nace, por una parte, como producto de un pacto en tal sentido y por otra, como consecuencia de la presencia de intereses del mandatario y terceros. Cuestionamos la aceptación general de los mandatos irrevocables sin hacer previamente estas distinciones que son fundamentales para determinar su aceptación o rechazo. El tema presenta gran interés pues se ha hecho una costumbre introducir esta clase de mandatos en todo tipo de contratos, en especial en los de adhesión y, además, se trata de aspectos muy poco tratados en la doctrina y jurisprudencia nacional.es-ES
