Liability insurance contract’s legal design grants the direction of the defense of the liability claim and lawsuit to the insurer. Sometimes, the interests of insurer and insured are opposed, which is manifested in the differences between them related to decisions about the defense of the liability claim or trial. The thesis that this work supports is that liability insurance’s legal regulation restricts the option to give the defense of the trial’s direction to the insurer only to cases of conflict of interests in a strict sense. The former does not mean that the other conflicts of interests do not produce any legal effects, but that these legal effects are others: those that arise from the agent’s tort liability in a collective agency.El diseño legal del seguro de responsabilidad civil confiere al asegurado la dirección de la defensa del reclamo y posterior litigio que puede dar lugar a responsabilidad cubierta. En ocasiones, los intereses de asegurador y asegurado se oponen, lo que se manifiesta en diferencias relativas a las decisiones sobre la defensa del juicio de responsabilidad civil. La tesis que se sostiene en este artículo consiste en que la regulación legal supletoria del seguro de responsabilidad civil restringe la opción de entregar la defensa del juicio al asegurado a casos de conflictos de intereses en sentido estricto. Lo anterior no significa que los demás con- flictos de intereses no produzcan efectos jurídicos, sino que estos efectos jurídicos son otros: los derivados de la responsabilidad civil del mandatario en un mandato colectivo.
