The object of this paper is to contribute to the growing development of contemporary contract theory in Chile. Contract law requires political justifi cation, and contract theory plays a crucial role in such justifi cation. The paper analyzes the need for a theory of contract law, explores its methodology and draws a distinction between the role of contract doctrine and contract theory. Finally, the paper analyzes their relationship.Este trabajo pretende contribuir al incipiente desarrollo de la teoría contemporánea del derecho de contratos en Chile. El derecho de contratos requiere ser justificado políticamente, y la teoría del derecho de contratos cumple un rol fundamental en dicha justificación.
