| dc.description | The adaptation of the concept and content of criminal responsibility to constitutional rights is one of the most serious omissions in criminal law discourse. The concept of criminal responsibility must return to the confrontation between the citizen and the State that existed during the Enlightment, not from a theoretical perspective and a pretended homogeneous rationality, but from the assumption of social inequality. The State is required to take an active stance in redistribution of the social goods. In criminal law this active stance is made real in the consideration of the person´s cultural, social and economic capabilities, in the process of imposing punishment. Criminal liability for the infringement of the law is not only the perpetrator´s but it is also society´s responsibility. | en-US |
| dc.description | La adecuación del concepto y contenido de la culpabilidad a los derechos constitucionales constituye una de las más importantes lagunas en el discurso penal. El concepto de culpabilidad debe volver a la antinomia entre ciudadano y Estado de la Ilustración, no desde una perspectiva abstracta y una supuesta racionalidad homogénea, sino desde la premisa de la desigualdad social. Ello obliga al Estado a una acción positiva de redistribución de los bienes sociales que en el ámbito penal se concreta en la toma de consideración a la hora de imponer la pena del acervo de bienes culturales, sociales y económicos del individuo. La responsabilidad no es sólo responsabilidad del autor por el injusto, sino también una responsabilidad social. | es-ES |
