| dc.description | This paper intends to demonstrate that it is a mistake to equate the Latin syntagm contrahere obligationem to the modern idea of concluding a contract, phenomenon that entails the formation of a false retrospective construction due to the anachronistic use of a modern dogmatic concept applied to the Roman legal experience. | dc.description | Este artículo intenta mostrar el error que radica en la equiparación entre el sintagma latino contrahere obligationem y la moderna idea de perfeccionar un contrato, fenómeno que trae consigo la formación de un constructo retrospectivo falso en virtud de la aplicación anacrónica de un concepto dogmático moderno a la experiencia jurídica romana. En el derecho romano clásico, la expresión contrahere obligationem hacía alusión a la actividad lícita concreta desplegada por un agente en orden a engendrar una obligación, es decir, a su causa, la causa obligationum. | es-ES |
