The present text summarizes the different constitutional traditions to confront their postulates before the recognition of new rights, especially the irruption of social rights. Thus, the analysis describes the three classical traditions that seek to establish an effective system of limits and counterweights to power: the English, the American and the French. Then, the German constitutional tradition is exposed in what concerns the recognition of certain fundamental values to avoid the consequences of pure positivism of the rules and the excesses of authoritarianism. The text continues with the irruption of social rights as a new constitutional tradition and the experience of multilevel constitutionalism in the European Union. At the end of the work, a series of problems that raise the tradition of social rights are exposed.El artículo resume las distintas tradiciones constitucionales con el objetivo de confrontar sus postulados ante el reconocimiento de nuevos derechos, en especial, la irrupción de los derechos sociales. De esta forma, el análisis describe las tres tradiciones clásicas que buscan instaurar un sistema eficaz de límites y contrapesos al poder, a saber: la inglesa, la americana y la francesa. Luego, expone la tradición constitucional alemana de la posguerra en lo que concierne al reconocimiento de ciertos valores fundamentales, a fin de evitar las consecuencias del positivismo puro de reglas y los excesos del autoritarismo. El texto continúa con la irrupción de los derechos sociales como nueva tradición constitucional y la experiencia del constitucionalismo multinivel de la Unión Europea. El trabajo concluye con una serie de problemas que plantea la tradición de los derechos sociales.
