dc.descriptionThis article refers to the dogmatic and practical problems generated by the fact that the commitment in which one party undertakes to construct, manufacture or produce goods, for the other party can be considered as a contract of sale or as a service contract. Based on historical and dogmatic arguments, it provides criteria to deal with the difficulties faced by the interpreter when classifying a particular commitment. It also refers to the rules that should govern the contractual relationship: the conclusion of the agreement as well as the delivery of the goods. Finally, it refers to the legal consequences that follow from the no performance or the lack of conformity of the goods, especially when the commitment is considered a contract of sale.en-US
dc.descriptionEste artículo se refiere a los problemas dogmáticos y prácticos que genera el hecho de que el encargo de la confección de una obra material pueda dar lugar alternativamente a dos contratos típicos: compraventa o arrendamiento. Sobre la base de argumentos históricos y dogmáticos, ofrece criterios para superar las dificultades que enfrenta el intérprete a la hora de calificar un contrato concreto. Asimismo, se refiere a las reglas que deben gobernar la relación contractual, desde la celebración al acuerdo, hasta la entrega de la obra. Finalmente, alude a las consecuencias jurídicas que se siguen de la no ejecución o ejecución imperfecta de la obra, especialmente en aquellos casos en que el encargo constituye compraventa.es-ES
