dc.descriptionThis study consists of a critical analysis of the Chilean legal system's regulations regarding insurance fraud, bearing relevance to Law No. 20.667 promulgated in May, 2013. This regulation, previously non-existent in the legal system and the Code of Commerce, addresses the hypothesis of fraud in matters of insurance regarding consequences for these types of violations and those who commit these crimes. The emphasis of the present study has been placed on the dogmatic and critical analysis of the new insurance fraud crime, and specifically of the behavior and itercriminis, the legislative technique and the political-criminal need to place an autonomous crime into effect.en-US
dc.descriptionEl presente trabajo tiene por objeto el análisis crítico de la regulación que el ordenamiento jurídico chileno establece con respecto al fraude de seguros. Lo anterior adquiere relevancia, toda vez que en el mes de mayo de 2013 se promulgó la Ley N° 20.667, que regula íntegramente la hipótesis de fraude en materia de seguros y añade a la normativa del Código de Comercio, en cuanto a remedios contra esta contravención, un tipo penal que viene a constituir el delito de fraude de seguros, del todo inexistente antes de la modifi cación legal. El énfasis de este estudio se ha puesto en el análisis dogmático y crítico del nuevo delito de fraude de seguros y, específi camente, en el comportamiento típico y el iter criminis, así como en la técnica legislativa y la necesidad político-criminal de contar con un tipo penal autónomo.es-ES
