The recent case-law of the Constitutional Court has increasingly applied international human rights law, especially in the field of military justice in Chile. This paper seeks to analyze this case-law; to determine the scope of the application of the international human rights standards, and specifically, to determine to which extent the Court is undertaking a control of conventionality. In the light of this case-law, the author argues that the Constitutional Court is implicitly carrying out a control of conventionality of the domestic norms.En la jurisprudencia reciente del Tribunal Constitucional se ha aplicado en forma creciente el Derecho internacional de los derechos humanos en el análisis argumentativo de los casos. Una jurisprudencia particularmente actual a este respecto la constituye aquella relativa a la jurisdicción militar. Este trabajo tiene por objetivo analizar la jurisprudencia reciente relativa a la jurisdicción militar, determinar la medida de la aplicación de los criterios y estándares del derecho internacional de los derechos humanos y, muy especialmente, establecer si el Tribunal efectúa, de algún modo, un control de convencionalidad. A partir de los casos examinados, en este estudio se sostiene que el Tribunal Constitucional realiza implícitamente un control de convencionalidad de las normas.
