Applies proper regulation of freezing and seizure of bank accounts with application of new technologies, due to the fact that, technically, nominal money is used along with a banking contract between a financial institution and a person (the executed/debtor in the enforcement procedure). In this contractual relationship the performer is a third party, and the financial institution has nothing to do with this person. This creates the need to balance the access to that information (both the creditor and the enforcement body), because personal data is especially protected by bank secrecy and the right to the protection of credit.Corresponde una adecuada regulación del congelamiento y embargo de cuentas bancarias con aplicación de las nuevas tecnologías en tanto nos encontramos, técnicamente, con dinero nominal y un contrato bancario entre la entidad fi nanciera y una persona (el ejecutado en la relación procesal). En esa relación contractual el ejecutante es un tercero y la misma entidad financiera no tiene relación alguna con aquel. Ello crea la necesidad de balancear el acceso a esa información (tanto por el acreedor como por el órgano de ejecución), por cuanto se trata de datos personales especialmente resguardados por el secreto bancario y el derecho a la tutela del crédito.
