| dc.description | This paper is a review, in the light of our case law, of the rules that allow different authorities to order a productive activity to be "relocated" or "removed" from a place, based on problems or hazards, usually environmental, that its operation involves. In each case the competent authority is required to issue the order, the requirements that must be met, deadlines involved and the position in which the concerned stands regarding are indicated. Furthermore, the paper analyzes the way in which this faculty of the municipal or health authorities to order the "relocation" or "removal" of an industry compromises the right to a "quality of life" of the affected population. | en-US |
| dc.description | Este trabajo es una revisión, a la luz de nuestra jurisprudencia, de las normas que permiten que distintas autoridades puedan ordenar que una actividad productiva sea “trasladada” o “retirada” de un lugar, por los problemas o riesgos generalmente ambientales que causa o implica su operación. Se precisa, en cada caso, la autoridad competente para dictar esta orden, los requisitos que debe cumplir, los plazos involucrados y la posición en que queda el afectado con la medida. Además, se analiza la forma en que esta función de las autoridades municipales o sanitarias para ordenar el “traslado” o “retiro” de una industria compromete el derecho a una “calidad de vida” de la población afectada. | es-ES |
